Since NO ONE has not answered my questions on POST 734 regarding the new 41F. I will help you out on yours.

If you are filing the Form 1, you will be the manufacture.

It's probably because you're leading the way here. I've not submitted a Form 1 or Form 4 since 41F went into effect.

It's permanent as You now have to send Fingerprints and their Dinosaur System can't handle that.

Quick question fellas.

All my form 1's had previously been filed using my trust.

Now with 41f in affect is there any reason I should file a form 1 using the trust as the applicant? Shouldn't I just apply as an individual applicant now?

A trust allows you to have trustees which can then use/have possession of your NFA items. For example, you can add family members as trustees and they can use your guns/silencers etc without you being there.

If you file as an individual, you would have to be in control of the NFA items at all times.

The reason I ask is because I am not going to have my wife (the only other person on my trust) get finger printed, photographed, and submit forms. What a bunch of total bullshit!

According to the firm that did my trust (Prince Law who specialize) I have a few options:

1. File as an individual
2. Amend trust so my wife is only a beneficiary
3. Remove her from the trust. Submit form 1's. Then add her back on once my form 1's are approved.

BTW, according to both of the law firms that specialize in 'NFA gun' trusts control and possession are key words. You can have beneficiaries (who have not been finger printed, etc) shoot and use your NFA items as long as you are present. Possession on the other would be if they had your trusts NFA items without you being present.

Depends on if you want your wife playing with your NFA items without you around. Option 3 is easy enough to do.

Also, as long as you present and keeping an eye on your NFA items (counts as control), anyone (who is not a felon...) can use your NFA items without them being on the trust. Meaning you can take your friend shooting and he can use your silencer or let the guy shooting in the next lane try out the sbr etc etc.

Another technical scenario: You file as individual, you keep your nfa item locked up in the safe, your wife knows the combo to the safe or you somehow left the safe open. In this case, you would be breaking the law because you are not in control of the nfa item. If she didn't know the combo and its properly secured then you would be safe.

There is no part of the NFA that requires persons who own NFA firearms to have a safe.

Where did I say you are required to have a safe?

I'm sorry, the NFA does not require the firearm to be secured. It can be kept leaning against the wall in the corner of the living room.

You're missing the point. If you are at home, then the item is arguably under your control. If you leave, and lock your house, then the item is secured (along with the house).

If you leave, and you happen to have a wife, child, friend, who is not authorized in the home, then you are afoul of the law.

Not sure why this is so hard for you.

Just passed 8 months on my couple of Form 1 submissions. They were sent in prior to the rule changes. Still waiting....

I'm around there too, I have stopped counting the days and just check my email periodically for the approved Form 1 Christmas present.

I mailed in my Form 1 Individual for SBR the first week of July 2016, and just got it back on Monday because there was an error on it. When the CLEO filled out the part that says he is the CLEO in the area of the firearm maker (me) he wrote my address instead of my name. It's my fault for not catching it, but at least I know what to look for now if/when I file another one. I called BATFE to make sure I corrected it properly and asked her if it goes back to the bottom of the pile. She laughed and said no, and said that I should have my stamp or a denial letter within 2-4 weeks. I hope she's right, I've already been waiting 8 months!

I personally find this somewhat encouraging. I e-filed my last two a couple days before 41F, and hard copy mailed one the day after (A denial due to an error that I was unable to re-e-file). So I may be receiving some news in a few weeks. I was really expecting about a year.
